What a complete load of crap. Could that headline be more hysterical?
And the very first sentence of that NYT article is #fakenews, y’all. The VERY FIRST SENTENCE.
It reads, “The Trump administration is considering narrowly defining gender as a biological, immutable condition determined by genitalia at birth, the most drastic move yet in a governmentwide effort to roll back recognition and protections of transgender people under federal civil rights law.”
Except that it isn’t. Fast forward to the 3rd paragraph, where it says (emphasis mine), “Now the Department of Health and Human Services is spearheading an effort to establish a legal definition of sex under Title IX, the federal civil rights law that bans gender discrimination in education programs that receive government financial assistance, according to a memo obtained by The New York Times.”
There is a difference between sex and gender. And the Trump administration is absolutely right to define sex according to its ACTUAL DEFINITION, and hold that that sex is unchangeable, is determined at birth, and grounded in science.
ALL OF THAT IS FREAKING TRUE.
The department further argues that any dispute about one’s sex would have to be clarified using genetic testing.
The reason liberals are freaking is because this definition ignores how people express their GENDER identity, which can, as we all know, conflict with one’s sex. But DHS argues that the term “sex” was never supposed to include gender identity, and that civil rights protections aren’t supposed to apply. Now, trans folks are all over Twitter posting photos of themselves with the hashtag #wontbeerased.
Much of this whole entire debate is centered around bathrooms, which became a Big Deal during the Obama administration, and he confused the issue by basically telling anyone to go to any bathroom they wanted, which caused a whole host of other problems.
If it were up to me, I’d say every public establishment needs to have a “family” restroom in addition to men’s bathrooms and women’s bathrooms, and if your gender identity doesn’t match your biology, then go to the family restroom and stop being such a freaking problem for the 97-99% of the population who is sick and tired of dealing with your crap.
If that sounds heartless, please understand that I’ve become REALLY CYNICAL about this issue ever since “gender fluidity” and “pangenderism” and the other 48 skillion new gender terms came into my consciousness thanks to progressive lunatics who can’t stop demanding attention. I was FINE with the Caitlyn Jenners of the world using women’s restrooms until progressives lost their collective minds and decided that instead of just trans folks changing from their birth-assigned gender to the opposite one, they were now going to change genders FROM MINUTE TO MINUTE and that those genders were “non-binary.”
Nope. Ya lost me on that one.
The issue of sex versus gender is important. According to the sourcelink:
A 2016 ruling by Judge O’Connor concerned a rule that was adopted to carry out a civil rights statute embedded in the Affordable Care Act. The provision prohibits discrimination based on race, color, national origin, sex, age or disability in “any health program or activity” that receives federal financial assistance.
But in recent discussions with the administration, civil rights groups, including Lambda Legal, have pointed to other court cases. In a legal memo presented to the administration, a coalition of civil rights groups wrote, “The overwhelming majority of courts to address the question since the most relevant Supreme Court precedent in 1998 have held that antitransgender bias constitutes sex discrimination under federal laws like Title IX.”
And it gets even hairier:
The department would have to decide what documentation schools would be required to collect to determine or codify gender. Title IX applies to a number of educational experiences, like sports and single-sex classes or programs where gender identity has come into play. The department has said it will continue to open cases where transgender students face discrimination, bullying and harassment, and investigate gender-based harassment as “unwelcome conduct based on a student’s sex” or “harassing conduct based on a student’s failure to conform to sex stereotypes.”

Hey – remember when the LGBT community came up with their four-letter acronym, and the B stood for “bisexual?” In fact, I think it still does. So someone help me out here – if bisexual refers to being sexually attracted to two possible sexes – either men or women, then can we all stop pretending there is anything outside of that binary now? IT’S YOUR OWN FREAKING ACRONYM.
