Judge Kavanaugh has, on multiple occasions throughout his hearing, asserted that much like Judge Kagan and other judges before her, he would not be commenting on how he would rule on hypothetical situations.
NO judge SHOULD.
A good judge should take ALL PARTS of a situation into consideration, and then hand down a ruling based on legal precedent.
To say what he would do in a hypothetical situation is stupid and reckless – because he doesn’t have all that much information to go on… seeing as the situation ISN’T REAL.
