College Students Fights Stupid Suspension Punishment And WINS

This is an update to the story we told you about yesterday. Remember Nick Lutz, the student from the University of Central Florida who had been suspended for “grading” his ex-girlfriend’s break-up/apology letter and posting on Twitter?

Good news! According to this, Lutz and his lawyer announced that they won their appeal against UCF. Lutz will NOT be suspended and he can go about his regularly scheduled college career –

He appealed his suspension on the grounds of the First Amendment. His lawyer, Jacob Stuart, claimed there was “nothing derogatory about [the publishing of the letter]. It was obvious he was making fun of her, but that’s the beauty of the constitution.”

Stuart stressed that Lutz only wants to continue studying at the university. “He doesn’t want money. He doesn’t want anything. He just wants to go back to school and graduate.”

Yesterday, he announced that his appeal was successful and he’s no longer suspended from the university.

As great as this news is – and it is GREAT news – this never should have been an issue in the first place. At the very worst, this was between Lutz and his ex-girlfriend. This was their relationship, their break-up, and their fight. The school never should have gotten involved. Even if the Lutz’s ex went to school administrators and threw a fit, the correct response from the school should have been “Not our problem. And you don’t even go to this school!”

Yeah, did you miss that? Lutz had previously indicated that his ex-girlfriend is not a student at UCF. Sooo… I have no idea why the school was fielding her complaints in the first place.

Either way, this is a win both for the First Amendment and for common sense sanity.
