Sometimes I just have to shake my head and wonder what these judges could possibly be thinking, when they do stuff like this.

You might recall that I wrote a while back about how awesome it was that Oklahoma voters decided that courts in OK should only be deciding cases on US and state law. AS IF THAT EVEN NEEDS TO BE DEBATED.

But now, a federal judge in OK has put a permanent injunction on the voters’ decision to forbid courts from considering international and Sharia law. Her rationale? “While the public has an interest in the will of the voters being carried out, the court finds that the public has a more profound and long-term interest in upholding an individual’s constitutional rights.” Whizzuh whuzzah? How does following US and state law NOT uphold an individual’s constitutional rights? Judge Vicki Miles-LaGrange had already issued a temporary restraining order in response to CAIR’s lawsuit which sought to nullify the law entirely. CAIR’s local leader said the whole ballot was nothing more than fear mongering, and suggested that Sharia law has nothing to do with Oklahoma.

But see – it does. It has everything to do with ALL of our states, because New Jersey already made it clear that it’s something we have to worry about, when a judge there ruled against a woman who asked for a restraining order against her husband because he kept raping her. The judge said the husband was just doing his Muslim thing, and he RULED AGAINST HER. Because screw US laws – what mattered here was that the husband was just doing what Islam allows him to do. That sort of set the stage, and Oklahoma didn’t really feel like taking any chances.

But here’s the thing. The Oklahoma measure simply states that it would “amend a state constitution section dealing with the state courts, making them rely on federal and state law when deciding cases, forbidding them from considering or using international law and from considering or using Sharia Law.” I don’t know about you all, but that doesn’t seem the slightest bit unconstitutional to me. You can have freedom of religion all you want, but you still have to follow the law, which, unfortunately for Muslim husbands apparently, means you don’t get to abuse your wife.

Why do we even need to DISCUSS this?? What’s next – is Arizona going to be sued for wanting to enforce federal law or something?
